These terms govern your use of Vibe Comms and define legal rights, obligations, and risk allocation.

1. Acceptance Of Terms
These Terms of Service ("Terms") form a legally binding agreement between you and Vibe Comms ("Vibe Comms", "we", "us", or "our") regarding your access to and use of the Vibe Comms website, desktop application, APIs, and related services (collectively, the "Service").
By creating an account, downloading the app, or using any part of the Service, you agree to be bound by these Terms and our applicable policies. If you do not agree, do not use the Service.
2. Eligibility And Authority
You must be at least 13 years old, or the minimum age required by law in your country, to use the Service.
If you use the Service on behalf of a company, team, guild, or other entity, you represent and warrant that you have authority to bind that entity to these Terms.
3. Accounts, Credentials, And Security
You are responsible for providing accurate account information and for maintaining the confidentiality of your login credentials.
You are responsible for all activity under your account. You must promptly notify us at [email protected] if you suspect unauthorized use of your account.
- Do not share credentials or access tokens with unauthorized parties.
- Use a strong, unique password and keep your authentication methods secure.
- You must not attempt to bypass account or session security controls.
4. Subscriptions, Billing, And Changes
Some features may be offered on a paid basis now or in the future. If you purchase paid features, you agree to pay all applicable fees, taxes, and charges under the pricing terms presented at purchase time.
We may update pricing, packaging, or feature availability at any time with reasonable prior notice when required by law.
5. Acceptable Use Rules
You agree not to misuse the Service. Prohibited behavior includes, without limitation:
- Violating any applicable law, regulation, sanction, or third-party right.
- Uploading, transmitting, or distributing malicious code, malware, or harmful scripts.
- Harassing, threatening, impersonating, doxxing, or abusing other users.
- Attempting unauthorized access, reverse engineering, scraping, or service disruption.
- Interfering with infrastructure, rate limits, integrity checks, or abuse controls.
- Using the Service for fraud, spam, deceptive conduct, or illegal coordination.
6. User Content And Licenses
You retain ownership of content you submit, transmit, or upload through the Service ("User Content").
You grant Vibe Comms a worldwide, non-exclusive, royalty-free license to host, process, store, reproduce, and transmit User Content solely as necessary to operate, secure, improve, and provide the Service.
You represent and warrant that you have all rights necessary to provide User Content and grant this license.
7. Intellectual Property
The Service, including software, branding, design, code, and documentation, is owned by Vibe Comms or its licensors and is protected by intellectual property laws.
Except for the limited rights expressly granted in these Terms, no rights or licenses are granted to you by implication or otherwise.
8. Third-Party Services
The Service may integrate with third-party services (for example, OAuth identity providers, infrastructure providers, or analytics providers). We are not responsible for third-party services, and your use of them may be governed by separate terms.
Open-source components may be included in the Service and are governed by their respective licenses.
9. Alpha/Beta Features
Certain features may be labeled alpha, beta, preview, or experimental. These features may be incomplete, unstable, or changed/removed at any time.
You use pre-release features at your own risk. We make no guarantee that beta features will become generally available.
10. Suspension And Termination
We may suspend, limit, or terminate access to the Service at any time if we reasonably believe you violated these Terms, created legal/security risk, or threatened service stability.
You may stop using the Service at any time. Sections that by nature should survive termination (for example, IP, disclaimers, liability limits, and dispute terms) will survive.
11. Disclaimer Of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
WE DISCLAIM IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
12. Limitation Of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBE COMMS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) AMOUNTS YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD $100.
13. Indemnification
You agree to defend, indemnify, and hold harmless Vibe Comms and its affiliates, officers, employees, contractors, and licensors from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to:
- Your use or misuse of the Service.
- Your User Content.
- Your violation of these Terms or applicable law.
- Your violation of any third-party rights.
14. Governing Law And Dispute Resolution
These Terms are governed by the laws of Poland, without regard to conflict-of-law rules.
Any dispute arising from or relating to these Terms or the Service will be resolved exclusively in the courts located in Poland, unless applicable law requires otherwise.
Before filing a claim, each party agrees to attempt good-faith informal resolution by contacting the other party first.
15. Export Control And Compliance
You represent and warrant that you are not located in, under the control of, or a national/resident of any country or person subject to embargoes or sanctions that would prohibit your use of the Service.
You will comply with all applicable export control and sanctions laws.
16. Changes To Terms
We may update these Terms from time to time. Material changes will be communicated through reasonable notice methods (for example, website notice, in-app notice, or email when available).
Your continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms.
17. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
Our failure to enforce any right or provision is not a waiver of that right or provision.
You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, reorganization, or sale of assets.
